    This as they said may effect the election.

    Wow! He was on the Supreme Court for a pretty long time! I wonder who Obama is going to nominate.

      On CNN they mentioned it "Might" be a fight by the GOP on any appointment. Not sure how it really works,but I imagine they should have 9 sitting Judges.

        What do you think are the odds of a new justice being appointed by the end of the year? I get the feeling that if Obama nominates someone, the Senate is going to try to stall until January

            The average time it takes for the senate to confirm a justice is 61 days. They have plenty of time to confirm one before Obama leaves office. Theres actually precedent for confirming a justice in an election year as it happened in February of 88 under Reagan with justice Kennedy. For the senate to shirk its constitutional responsibility on this just because they hope a republican wins the white house is pure horses**t, and shows how much republicans prize being political over serving the people. The people elected Obama by 5 million votes he should be the one to pick a justice IMO.

                It is common for one party to object to the appointment of the other party's nomination of a supreme court judge. That is one of the division of powers that is built into the constitutional republic in which we live. If Obama selects someone who is not acceptable to both parties then the majority party can stop the appointment. This challenges the president to select someone who is considered fair to the peoples rights. Putting a person who is publicly against the rights listed in our constitution would be disastrous for our country's health and welfare as well as the welfare of the people. We do not live in a democracy where a majority vote can remove the rights of others. Our rights are beyond political power. Since the supreme court is the last legal steps in protecting those rights the only way to keep it in place is to have agreement on the justices.
                With Obama's disdain for the rights listed in the bill of rights to be protected by the federal and all of government I believe it would be difficult for the senate to approve most nominations to the court. He has already appointed two justices while the senate was controlled by the Democrats but I think it will be more difficult to get approval on this, the third of his appointments.
                The Dragon sees infinity and those it touches are forced to feel the reality of it.

                    Actually I read the constitution and the "Political Writings during the Founding Era"(volume one and two) as well as the "Political Sermons of the American Founding Era. It is interesting and sad that so many people don't understand that we were given a Republican form of government over a democratic one. There is a big difference between the two.
                    Even our politicians talk about our democracy- which has never existed.

                        I am not really sure how these things will go anymore...And one thing,what worked for the founding Fathers,might not work today. They could not have predicted the state of our country today. Strict observance of their ideas might keep us in their world and effect how we live today with no regard for what can work NOW!

                          Well, you are right in your statement but I doubt you agree with me in where and how the founding fathers were wrong.
                          The limitations that are supposed to govern the federal government (called the constitution) have obviously not been allowed to get in the way of the power hungry feds. The promise of the constitution to provide a Republican form of government to all the states has been left in the dusts of time. We have been steadily moving toward socialism since at least 1933.

                            Nations evolve,and if there is no change,things may begin to stagnate. We live here in the 21st century,and even now we are having a hard time understanding how to help the laws and Government work with the fast changing environment both governing and planet wide change.
